Privacy Shield

Infratects LLC dba Analytects, Hereinafter collectively referred to as “Analytects”, “we”, “us” or “our”) believes in protecting our user’s privacy.  Our privacy policies detailed below comply with the EU-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union to the United States. Analytects has certified to the Department of Commerce that it adheres to the Privacy Shield Principles.  If there is any conflict between the terms in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern.  To learn more about the Privacy Shield program, and to view our certification, please visit https://www.privacyshield.gov/.

1. INFORMATION WE COLLECT AND USE

Analytects collects/uses/or has access to the following types of information:

  • Names and contact details for prospective clients.

  • Names, usernames and contact details for Support Contract clients and their systems users.

  • Names and contact details for employees of Analytects corporate divisions and corporate partners.

(Contact details may include any or all of the following: e-mail address, phone number(s), mailing address, time zone, company, job title.)

Depending on your relationship to us, we will use the gathered information for marketing purposes, and to provide the services and support, and communications related to those activities to our clients and corporate divisions or corporate partners.

2. ONWARD TRANSFER TO 3RD PARTIES

Circumstances in which your information may be shared with 3rd parties:

Analytects recognises potential liability in cases of onward transfer to third parties. Analytects will not transfer any personal information to a third-party without first ensuring that the third-party adheres to the Privacy Shield principles.  We share personal information described here and only with individuals or companies that adhere to the Privacy Shield principles.  Any third-parties utilise are specifically contracted to provide services for our clients.  They have access to personal information needed to perform their functions, but may not use it for other purposes. If we are ever required to disclose information by court order, subpoena, search warrant, or other legal process, we will do so.

3. CHOICE

Choices you may have to affect our collection and use of your information:

Other than as set forth in Section 2, Analytects will give users the opportunity to opt out of any information sharing with 3rd parties or any alternate use of their information. Analytects will also not share information with 3rd parties if you opt-out of this by informing us of that you do not wish us to share your information. You can opt out of sharing information by contacting us via e-mail at infosec@analytects.com. Analytects does not generally collect any sensitive data. If we do collect this information for any reason, we will provide users with notice and an opportunity to choose to share such information with any third parties.

4. SECURITY

Analytects is committed to following industry standard security best practices when storing or using user information. Reasonable precautions will be taken to ensure security of information. We will always attempt to protect users’ information from loss, misuse, unauthorised access, disclosure, alteration and destruction. It is important for users to protect against unauthorised access to their password and to their computer.

5. DATA INTEGRITY

Analytects only collects personal information that is relevant for the purposes for which it is to be used. Analytects will take reasonable steps to ensure that data is reliable for its intended use, accurate, complete, and current.

If users need to correct, amend or delete incorrect information they can contact us at infosec@analytects.com to request any required changes.

When contacting us with requests for information or requests for changes to your information we will require enough information to reasonably verify your identity prior to responding to, or implementing any changes requested by you. In any case where we are not satisfied as to your identity we will communicate in writing the details of any denials and the reasons for such denials with you.

6. ENFORCEMENT

Analytects is subject to the investigatory and enforcement powers of the Federal Trade Commission (FTC).

In compliance with the Privacy Shield Principles, Analytects commits to resolve complaints about our collection or use of your personal information.  Individuals in the European Union with inquiries or complaints regarding our Private Shield policy should first contact Analytects at:

Analytects has further committed to refer unresolved Privacy Shield complaints to JAMS ADR EU-U.S. Privacy Shield, an alternative dispute resolution provider located in the United States. If you do not receive timely acknowledgement of your complaint from us, or if we have not addressed your complaint to your satisfaction, please contact or visit https://www.jamsadr.com/eu-us-privacy-shield for more information or to file a complaint.  The services of JAMS ADR EU-U.S. Privacy Shieldare provided at no cost to you.

EU Persons (EU Data Subjects) may complain to their home data protection authority and can invoke binding arbitration for some residual claims not resolved by other redress mechanisms.

If you have a comment or concern that cannot be resolved with us directly, you may contact the competent local data protection authority.

Analytects reserves the right to change this Privacy Policy at any time for any reason, without notice. Any such modifications will be effective as of the date on which they are published.
